The Rules establish a comprehensive framework for the grant of authorisation for possession of radio equipment, whether acquired through purchase, import, or hire, including SIM Boxes, telecommunication blocking equipment, and other radio equipment, for the purposes of manufacture, sale, letting on hire, testing, and demonstration. The Rules also prescribe the procedures relating to the grant, renewal, surrender, suspension, cancellation, disposal, and compliance of such authorisations, in accordance with the provisions of the Telecommunication Act, 2023.
The Telecommunications (Radio Equipment Possession Authorisation) Rules, 2026 provide a regulatory framework for granting authorisation to eligible entities for lawful possession of radio equipment. The authorisation enables applicants to possess radio equipment –
- For manufacture, purchase, import for sale, hiring, repair, testing, and demonstration
- For import, purchase, or hire exclusively for testing and demonstration purposes.
- The Rules also prescribe the renewal, modification, surrender, disposal and compliance obligations.
The following entities are eligible to apply for Radio Equipment Possession Authorisation under the Telecommunications (Radio Equipment Possession Authorisation) Rules, 2026:
- A Company or Limited Liability Partnership (LLP), subject to compliance with the applicable Foreign Direct Investment (FDI) policy and other applicable laws.
- A Person, including a Partnership Firm or Sole Proprietorship, holding a valid licence, permit, or registration under the applicable law to carry on a trade or business.
- The Central Government, State Government, or any agency designated by the Central Government or State Government for possession of radio equipment.
- A person holding a licence under the Indian Wireless Telegraphy (Possession) Rules, 1965.

Certified copy of approval of the Government of India for foreign equity (wherever applicable as per policy issued by the Government of India from time to time in respect of foreign direct investment and applicable law)
Certified copy of appointment letter of auditor by resolution of the Board of Directors and acceptance letter from the auditor.
For Government Departments/Organizations: Upload the Government Order/Notification/Office Order/Resolution under which the department or organization has been constituted or authorized to operate.
Certified copy of certificate of incorporation along with Articles of Association and Memorandum of Association.
Certificate in respect of net worth of the applicant.
Certificate in respect of paid-up equity capital of the applicant.
Certificate for breakup of paid-up equity capital into Indian and foreign equity and further breakup of foreign equity details given at serial no. 1(g).
Certificate certifying that foreign direct investment (including from countries sharing land border with India), if any, in the applicant is in conformity with the policy issued by the Government of India
Certificate certifying the applicant's compliance under the Telecommunications (Radio Equipment Possession Authorisation) Rules, 2026
- A non-refundable application fee of ₹1,000 shall be payable for submission of an application for grant of authorisation.
- An authorisation fee of ₹10,000 per annum shall be payable for authorisations under Rule 4(1)(a) relating to manufacture, purchase or import for sale, letting for hire, repair, testing or demonstration of radio equipment.
- An authorisation fee of ₹2,000 per annum, or a proportionate amount for a period of less than one year, subject to a minimum authorisation fee of ₹500, shall be payable for authorisations under Rule 4(1)(b) relating only to import, purchase or hire of radio equipment for testing or demonstration.
- A non-refundable application fee of ₹1,000 shall be payable for modification of an existing authorisation.

Application Submission-
Submit the application online through the designated portal in the prescribed form and manner.

Upload Documentations and Payment Receipt-
Furnish the required documents and information, including the make, model, and quantity of the radio equipment, and pay the non-refundable application fee of ₹1,000. Where applicable, submit the permission obtained under Section 48 of the Telecommunications Act, 2023 for telecommunication blocking equipment.

Examination by Government-
The Central Government examines the application, verifies the applicant's eligibility, and may seek additional information or undertake security vetting, where applicable.

Letter of Intent (LoI)-
If the applicant is found eligible, the Central Government issues a Letter of Intent (LoI) through the portal specifying the requirements to be fulfilled, including payment of the applicable authorisation fee.

Grant of Authorisation-
Upon fulfilment of all requirements specified in the Letter of Intent, including payment of the authorisation fee, the Central Government grants the Radio Equipment Possession Authorisation through the designated portal.
